Welcome to The Embroider. By accessing this website or placing an order for any of our services, you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully. Should you disagree with any part of these terms, we advise you to refrain from using our website or services.
Terms & Condition
1. Our Services
The Embroider offers embroidery digitizing, vector art conversion, custom patches, DTF printing, logo design and branding, as well as web design and development services. Because every order is built around your artwork, specifications, or project requirements, our services are custom in nature. You are responsible for reviewing your order details, artwork, and approvals carefully before production or final delivery begins.
2. Intellectual Property
All text, graphics, layouts, and branding on theembroider.com remain the property of The Embroider and are protected by copyright and other intellectual property laws. Unauthorized use, reproduction, or reuse of any content is strictly prohibited and may result in legal repercussions.
3. Order Placement and Approval
Placing an order, whether through our quote form, your client account, email, or WhatsApp, constitutes a request for our services. We reserve the right to accept or decline any order for any reason, including artwork that is unclear, incomplete, or restricted under our content guidelines.
For digitizing, vector, and patch orders, we recommend reviewing the sew-out, proof, or digital sample provided before final production. The Embroider is not responsible for issues arising from artwork or specifications that were approved without review.
For web design, development, logo, and branding projects, work begins once we’ve confirmed your project scope, and each deliverable moves forward only after written approval of the prior stage.
4. Pricing and Payments
All prices are listed in USD and are subject to change without notice. Pricing for standard services is shown on our website; custom or complex projects are quoted individually.
In keeping with our approach across every service we offer, you are not charged until you’re satisfied with the work. Once your files, patches, or project deliverables are approved, payment is due before final files are released or physical goods are shipped.
All payments are processed securely through PayPal, Stripe, American Express, or your preferred Debit/Credit Card.
5. Turnaround Time
Turnaround times vary by service and are listed on our website and in your order confirmation. Standard digitizing orders are typically completed within 4 to 12 hours; vector, patches, DTF, branding, and web projects follow scope-specific timelines. However, turnaround times may be affected by order volumes, revision requests, or unforeseen technical issues. We will notify you of any significant delays to ensure clear, transparent communication.
All vectorized, digitized, and source files will be electronically delivered to the customer’s provided email address, while custom patches may be physically posted to the provided postal address.
6. Revisions and Minor Edits
We are committed to ensuring your satisfaction before processing payments. This includes minor edits, resizing, color changes, and small format corrections, and are free of charge within a reasonable scope of the original order. Requests that substantially change the design, layout, or project brief beyond the original request may be treated as a new order and quoted accordingly.
7. Ownership of Files
Once a digitizing, vector, patch, logo, or branding project is completed and paid for, full ownership of the final files transfers to you. You are free to use, reproduce, resell, or modify your delivered files without restriction, and The Embroider does not retain any ownership claim over them.
8. Your Artwork and Copyright Responsibility
You confirm that any logo, artwork, photo, brand name, or design you submit to us is either your own original work or that you hold the rights necessary to use and reproduce it. The Embroider does not verify ownership or licensing of customer-submitted artwork and accepts no liability for any copyright, trademark, or intellectual property dispute arising from material you provide.
By submitting artwork, you agree to indemnify and hold The Embroider harmless from any claims, liabilities, damages, or expenses arising from the use of that material. We reserve the right to decline any order involving artwork we reasonably believe infringes on the rights of a third party.
9. Cancellations and Refunds
Cancellation and refund terms differ depending on whether your order involves digital files, physical goods, or a project-based service. Please review our Refund and Cancellation Policy to understand when and how to cancel an order and request a refund.
In general, orders may be cancelled before production begins; once production, digitizing, or project work is underway, cancellation may not be possible or may be subject to charges for work already completed.
10. Web Design and Development Projects
Web design and development projects are governed by these Terms in addition to the specific scope, timeline, and deliverables agreed for your project. Unless otherwise agreed in writing, our responsibility ceases upon delivery of the agreed design, build, or source files; ongoing hosting, domain registration, and third-party subscriptions are your responsibility unless separately contracted.
Feedback and approvals are required at each project stage before we proceed to the next.
11. Account Suspension
We reserve the right to suspend or terminate access to your account or decline future orders in cases of abusive conduct toward our team, fraudulent activity, misuse of our services, or repeated failure to meet payment obligations.
12. Limitation of Liability
The Embroider is not liable for indirect, incidental, or consequential damages arising from the use of our services, including losses related to production delays, third-party embroidery or printing equipment, or issues arising after a file or project has been approved by you. Our total liability for any order is limited to the amount paid for that order.
13. Third-Party Links
This website may contain links to third-party websites, including social media, payment processors, or partner platforms. We are not responsible for the content, policies, or practices of any third-party site and do not endorse them by linking to them.
14. Privacy Policy
Your use of this website and our services is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.
15. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the United States of America, without regard to conflict of law principles.
